This is a tool to help you determine the minimum cash wage to be paid to you by your employer. Several factors can affect your minimum wage, including the date, the location of your employment, and any tips you receive.

While this tool does account for common scenarios, there are additional aspects of minimum wage law not covered by this tool. These aspects may result in further adjustments to your pay.

A public employer is an employer of any government entity including towns, or county employers, except for certain non-teaching employers.

Do you work for a non-profit employer? (tell me more)

A non-profit employer or non-profit making institution means any corporation, unincorporated association, community chest, fund or foundation organized and operated exclusively for religious, charitable or educational purposes, with no part of the net earnings providing any continual benefit to any private shareholder or individual.

A fast food employer is any business that meets the following criteria:

  • Primarily serves food or drinks, including coffee shops, juice bars, donut shops, and ice cream parlors; and
  • Offers limited service where customers order and pay before eating, including restaurants with tables but without full table service and places that only provide take-out service; and
  • Is part of a chain of 30 or more locations, including individually-owned establishments associated with a brand that has 30 or more locations nationally.

New York State law allows employers in certain situations to take a credit towards the minimum wage for tips received by an employee. Please answer the following questions to determine the final minimum wage to be paid to you by your employer.

You work in an occupation where tips are customarily earned and you regularly receive tips each work week.

Hospitality- The hospitality industry includes restaurants and hotels. A restaurant includes any eating or drinking place that prepares and offers food or beverage either on any of its premises or by such service as catering, banquet, box lunch, curb service or counter service. A hotel is any establishment which offers lodging accommodations to the public, to employees, or to members.

Building Services- The building service industry includes any person, corporation or establishment engaged in whole or in part in renting, servicing, cleaning, maintaining, selling, or managing buildings or building space, and all occupations, operations and services in connection therewith or incidental thereto. The industry includes, but is not limited to, real estate owners, building owners, operators, lessors, managing agents and independent contractors.

Miscellaneous- The miscellaneous industry includes all industries other than hospitality, building service, farm, or not for profit establishments (that have chosen to be exempt from minimum wage coverage). For example: car washes, construction contractors, transportation companies, retail or healthcare establishments would be included in the Miscellaneous Industries.

A food service worker is any employee who is primarily engaged in the serving of food or beverages to guests, patrons or customers in the hospitality industry, including, but not limited to, wait staff, bartenders, captains and bussing personnel; and who regularly receives tips from such guests, patrons or customers. The term food service worker shall not include delivery workers.

Resort hotels are those that offer lodging mainly for vacation purposes, and do not stay open for more than 7 months per year.
